CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

GENERAL:

1. By placing an order electronically through this website, you are deemed to have accepted the preliminary information form and the distance sales agreement provided to you.
2. Buyers are subject to the provisions of the Law on the Protection of Consumers No. 6502 and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) as well as other applicable laws concerning the sale and delivery of purchased goods.
3. Buyers are responsible for shipping costs associated with the delivery of the purchased goods.
4. Each product purchased is delivered to the address specified by the buyer within a maximum legal period of 30 days. If the product is not delivered within this period, buyers can terminate the agreement.
5. The purchased product must be delivered completely, in accordance with the specified qualities in the order, and with its warranty certificate, user manual, and similar documents, if any.
6. If the sale of the purchased product becomes impossible, the seller must notify the buyer in writing within 3 days of becoming aware of this situation and must refund the total price to the buyer within 14 days.

IF THE PRODUCT PRICE IS NOT PAID:
7. If the buyer does not pay for the purchased product or cancels the payment in bank records, the seller's obligation to deliver the product is terminated.

PURCHASES MADE USING UNAUTHORIZED CREDIT CARD USE:
8. If it is determined that the credit card used for payment was unauthorizedly used by others after the product has been delivered and the relevant bank or financial institution does not pay the seller for the product, the buyer must return the product to the seller within 3 days, with the shipping costs borne by the seller.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:
9. If unforeseen circumstances prevent the seller from delivering the product on time, the situation is communicated to the buyer. The buyer may request the cancellation of the order, the replacement of the product with a similar one, or the postponement of delivery until the impediment is resolved. If the buyer cancels the order:

• If payment was made in cash, the amount is refunded in cash within 14 days from the cancellation.
• If payment was made by credit card and the buyer cancels the order, the product price is refunded to the bank within 14 days, but the bank may transfer the amount to the buyer’s account within 2–3 weeks.

BUYER'S RESPONSIBILITY TO INSPECT THE PRODUCT:
10. The buyer must inspect the goods/services subject to the agreement before taking delivery and not accept damaged or defective goods/services, such as crushed, broken, or torn packaging, from the shipping company. Goods/services received are considered to be in good condition and undamaged. After delivery, the buyer must carefully preserve the goods/services. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must also be returned along with the product.

RIGHT OF WITHDRAWAL:
11. The buyer may exercise the right to withdraw from the agreement by rejecting the goods without any legal or criminal liability and without giving any reason, by notifying the seller via the contact information below within 14 (fourteen) days from the delivery date of the purchased goods to the buyer or the person/entity indicated by the buyer.

DURATION OF THE RIGHT OF WITHDRAWAL:
13. For service contracts, this 14-day period starts from the date the agreement is signed. The right of withdrawal cannot be exercised for service contracts where the performance of the service begins with the consumer's consent before the withdrawal period ends.
14. The costs arising from exercising the right of withdrawal are borne by the seller.
15. To exercise the right of withdrawal, the seller must be notified in writing within 14 (fourteen) days via registered mail, fax, or email, and the product must not have been used, in accordance with the "Products for Which the Right of Withdrawal Cannot Be Exercised" provisions of this agreement.

CONDITIONS FOR EXERCISING THE RIGHT OF WITHDRAWAL:
16. The invoice for the product delivered to the third party or the buyer (if the product's invoice is issued to a corporate entity, it must be returned with a return invoice issued by the corporate entity).
17. The return form and the product to be returned, including its box, packaging, and standard accessories (if any), must be delivered completely and undamaged.

RETURN CONDITIONS:
18. The seller is obligated to refund the total amount and return all documents that place the buyer under financial obligation within 10 days of receiving the withdrawal notification and must accept the return of the goods within 20 days.
19. If a reduction in the product's value occurs or the return becomes impossible due to the buyer's fault, the buyer must compensate the seller for damages in proportion to their fault. However, the buyer is not responsible for changes or deterioration caused by the proper use of the product within the withdrawal period.
20. If the use of the right of withdrawal causes the campaign limit set by the seller to be exceeded, the discount amount utilized in the campaign is canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:
21. The right of withdrawal cannot be exercised for the following:

• Products prepared in accordance with the buyer's requests or personal needs,
• Underwear bottoms, swimwear, bikini bottoms, makeup products,
• Single-use items,
• Perishable goods or products at risk of expiration,
• Goods unfit for return due to health and hygiene reasons if their packaging has been opened after delivery,
• Mixed goods inseparable by nature,
• Periodicals such as newspapers and magazines (excluding subscription agreements),
• Services performed instantly in an electronic environment,
• Intangible goods delivered instantly to the consumer,
• Products with opened packaging such as audio or video recordings, books, digital content, software programs, data recording and storage devices, and computer supplies.

22. To return cosmetics, personal care products, underwear, swimwear, bikinis, books, copyable software, DVDs, VCDs, CDs, tapes, and stationery supplies (toners, cartridges, ribbons, etc.), their packaging must be unopened, untested, undamaged, and unused.

DEFAULT AND LEGAL CONSEQUENCES:
23. If the buyer defaults on credit card payment transactions, they agree to pay interest and be liable to the bank under the credit card agreement. In such cases, the relevant bank may take legal action, and the buyer agrees to pay the resulting expenses and attorney fees. In case of default, the buyer agrees to compensate the seller for damages resulting from the delay.

24. Payments can be made via bank transfer or EFT to one of our TL accounts at ............, .......... Bank.
25. Online payments with credit cards are available. You can opt for a single payment or installment options. The total amount will be charged to your credit card at the end of your order.
